Bu Kullanım Koşulları ("Koşullar"), Lotus uygulamasını ("Uygulama") kullanımınızı düzenler. Uygulamayı indirerek, bir hesap oluşturarak veya Uygulamayı kullanarak bu Koşulları kabul etmiş olursunuz. Koşulları kabul etmiyorsanız Uygulamayı kullanmamalısınız.
Bu Koşullar, Uygulamayı "lodlabs" markası altında geliştiren gerçek kişi Özberk Dicle ("biz") ile siz ("kullanıcı") arasında bir sözleşme niteliğindedir. Uygulamayı kullanmaya devam etmeniz Koşulları kabul ettiğiniz anlamına gelir.
Lotus, Türkiye'deki Tıpta Uzmanlık Sınavı (TUS) adaylarına yönelik bir mobil eğitim uygulamasıdır. Uygulama; aralıklı tekrar (FSRS algoritması) yöntemiyle çalışan kartlar, boşluk doldurma (cloze) kartları ve ders notları sunar. İçerik zamanla güncellenebilir, genişletilebilir veya değiştirilebilir.
Uygulamayı yalnızca kişisel ve ticari olmayan çalışma amacıyla kullanabilirsiniz. Aşağıdakileri yapmamayı kabul edersiniz:
Uygulamanın bazı özellikleri ücretli abonelik gerektirebilir. Abonelikler aylık veya yıllık olarak sunulabilir.
Uygulamadaki tüm içerik — kartlar, ders notları, metinler, içeriğin derlenmesi ve düzenlenmesi, görsel tasarım, arayüz ile "Lotus" ve "lodlabs" adları ve logoları dahil — Özberk Dicle'ye (lodlabs markası) aittir veya lisanslıdır ve telif hakkı ile ilgili mevzuatla korunmaktadır. Bu Koşullara uymanız şartıyla, Uygulamayı yalnızca kişisel çalışma amacıyla kullanmanız için size sınırlı, kişiye özel, devredilemez ve münhasır olmayan bir kullanım hakkı tanınır. Bu hak, içeriğin mülkiyetini size devretmez.
Uygulamadaki içerik yalnızca eğitim ve sınava hazırlık amaçlıdır. İçerik; resmi tıp eğitiminin, ders kitaplarının veya güncel klinik kılavuzların yerine geçmez ve hasta teşhis veya tedavisine yönelik tıbbi tavsiye niteliği taşımaz.
Uygulamanın kullanımı TUS'ta veya herhangi bir sınavda başarıyı, belirli bir puanı ya da herhangi bir sonucu garanti etmez.
İçeriğin doğru ve güncel olması için makul çaba gösterilse de hata veya eksiklik bulunabilir. Önemli bilgileri her zaman güvenilir kaynaklardan doğrulamanız önerilir. Uygulama "olduğu gibi" ve "mevcut haliyle" sunulur.
Yürürlükteki hukukun izin verdiği azami ölçüde, Uygulamanın kullanımından doğan dolaylı, arızi veya sonuç niteliğindeki zararlardan sorumlu tutulamayız. Bu madde, tüketici mevzuatından doğan yasal haklarınızı sınırlamaz.
Bu Koşulları ihlal etmeniz halinde hesabınızı askıya alabilir veya sonlandırabiliriz. Siz de dilediğiniz zaman Uygulamayı kullanmayı bırakabilir ve Ayarlar → Hesabı Sil yolundan hesabınızı silebilirsiniz. Hesabın silinmesi, mevcut bir abonelik döneminin ücretini otomatik olarak iade etmez; abonelik iptali için yukarıdaki 5. madde geçerlidir.
Uygulama Apple App Store üzerinden dağıtılmaktadır. Bu Koşullar yalnızca sizinle lodlabs (Özberk Dicle) arasındadır; Apple bu sözleşmenin tarafı değildir. Apple, Uygulamadan veya içeriğinden sorumlu değildir ve Uygulamaya ilişkin herhangi bir destek sağlama yükümlülüğü altında değildir. Bununla birlikte Apple, bu Koşulların üçüncü taraf lehtarıdır ve Koşulları size karşı uygulama hakkına sahiptir. Uygulamaya ilişkin destek talepleriniz için [email protected] adresine yazabilirsiniz.
Bu Koşulları zaman zaman güncelleyebiliriz. Önemli değişikliklerde Uygulama içi bildirim yapılır. Değişikliklerin yürürlüğe girmesinden sonra Uygulamayı kullanmaya devam etmeniz, güncellenmiş Koşulları kabul ettiğiniz anlamına gelir.
Bu Koşullar Türkiye Cumhuriyeti kanunlarına tabidir ve bu kanunlara göre yorumlanır. Tüketici sıfatını taşımanız halinde, uyuşmazlıklarda yetkili Tüketici Hakem Heyetleri ve Tüketici Mahkemeleri'ne başvurabilirsiniz.

These Terms of Service ("Terms") govern your use of the Lotus app ("the App"). By downloading, creating an account, or using the App, you agree to these Terms. If you do not agree, you should not use the App.
These Terms form an agreement between Özberk Dicle, an individual developer operating under the "lodlabs" brand ("we"), and you ("the user"). Your continued use of the App means you accept these Terms.
Lotus is a mobile education app for candidates preparing for the Turkish Medical Specialty Exam (TUS). It provides spaced-repetition cards (using the FSRS algorithm), cloze-deletion cards, and lecture notes. Content may be updated, expanded, or changed over time.
You may use the App only for personal, non-commercial study. You agree not to:
Some features of the App may require a paid subscription. Subscriptions may be offered on a monthly or yearly basis.
All content in the App — including cards, lecture notes, text, the compilation and arrangement of content, visual design, the interface, and the "Lotus" and "lodlabs" names and logos — is owned by or licensed to Özberk Dicle (the lodlabs brand) and is protected by copyright and related laws. Subject to your compliance with these Terms, you are granted a limited, personal, non-transferable, non-exclusive right to use the App for personal study only. This right does not transfer ownership of any content to you.
The content in the App is for educational and exam-preparation purposes only. It is not a substitute for formal medical education, textbooks, or current clinical guidelines, and it does not constitute medical advice for diagnosing or treating patients.
Use of the App does not guarantee success, any particular score, or any result in the TUS or any other exam.
While reasonable effort is made to keep the content accurate and current, errors or omissions may occur. You should always verify important information against reliable sources. The App is provided "as is" and "as available".
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App. This section does not limit your statutory rights under consumer law.
We may suspend or terminate your account if you violate these Terms. You may stop using the App at any time and delete your account via Settings → Delete Account. Deleting your account does not automatically refund the fee for an active subscription period; Section 5 above applies to subscription cancellation.
The App is distributed through the Apple App Store. These Terms are between you and lodlabs (Özberk Dicle) only; Apple is not a party to this agreement. Apple is not responsible for the App or its content and has no obligation to provide any support for it. However, Apple is a third-party beneficiary of these Terms and has the right to enforce them against you. For support regarding the App, please write to [email protected].
We may update these Terms from time to time. Material changes will be announced inside the App. Continued use of the App after changes take effect means you accept the updated Terms.
These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye. If you are a consumer, you may bring disputes before the competent Consumer Arbitration Committees (Tüketici Hakem Heyetleri) and Consumer Courts (Tüketici Mahkemeleri).
